Welcome to Morning Attire. The terms "we," "us," and "our" refer to Morning Attire LLC, a limited liability company organized under the laws of the State of Wisconsin. Morning Attire operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Morning Attire is powered by Shopify, which enables us to provide the Services to you.

These terms and conditions, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy (collectively, these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms of Service carefully. They include important information about your legal rights, including warranty disclaimers, limitations of liability, and dispute resolution.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you should not use or access our Services.

SECTION 1 — ELIGIBILITY AND ACCOUNT

You must be at least 18 years old or the age of majority in your jurisdiction to make a purchase. If you are under 18, you may browse our website but must have a parent or legal guardian complete any purchase on your behalf.

To use the Services, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You agree to notify us promptly of any unauthorized use. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 — OUR PRODUCTS

All of our apparel products are made-to-order using print-on-demand production — each item is printed and produced specifically for your order after purchase. We make every effort to display product colors and images accurately; however, actual colors may vary slightly due to monitor settings and display calibration. Minor variations inherent to the print-on-demand manufacturing process do not constitute defects.

All product descriptions and availability are subject to change at any time without notice. We reserve the right to discontinue any product and to limit quantities offered to any person, geographic region, or jurisdiction.

SECTION 3 — ORDERS AND CANCELLATIONS

When you place an order, you are making an offer to purchase. Your order is confirmed when you receive an email confirmation from us. We reserve the right to refuse or cancel any order due to product unavailability, pricing errors, or suspected fraud. If we cancel your order, you will receive a full refund.

Because our products are made to order, cancellations may be requested within 2 hours of order placement, provided production has not yet begun. To request a cancellation, email support@morningattire.com with your order number immediately. Once production has started, we are unable to cancel or modify your order.

Your purchases are subject to return or exchange solely in accordance with our Return & Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 — PRICES AND BILLING

Prices are listed in US dollars (USD) and do not include applicable sales tax or shipping charges, which are calculated and displayed during checkout. Prices, discounts, and promotions are subject to change without notice; however, price changes will not affect orders that have already been placed and confirmed.

Payment is processed securely through Shopify Payments at the time of order placement. We accept major credit cards, debit cards, Apple Pay, Google Pay, and Shop Pay. You represent and warrant that your payment information is true, correct, and complete, and that you are authorized to use the payment method provided.

SECTION 5 — SHIPPING AND DELIVERY

Shipping timelines, costs, and policies are detailed in our Shipping Policy. Estimated delivery dates are not guaranteed and may vary due to carrier volume, weather, or other factors outside our control. Once we transfer products to the shipping carrier, title and risk of loss passes to you. Please ensure your shipping address is accurate — we are not responsible for packages delivered to an incorrect address you provided.

SECTION 6 — INTELLECTUAL PROPERTY

All content on this website, including text, photographs, images, graphics, logos, designs, artwork, video, and audio, and the design, selection, and arrangement thereof, is the property of Morning Attire LLC or its licensors and is protected by United States and international copyright, trademark, and intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any material on the Services without our prior written consent. You may share links to our website and products for non-commercial purposes.

Morning Attire's names, logos, product and service names, designs, and slogans are trademarks of Morning Attire LLC. All other marks on the Services are the trademarks of their respective owners. All rights not expressly granted herein are reserved.

SECTION 7 — USER CONDUCT

You agree to use our website only for lawful purposes. You may not: attempt to gain unauthorized access to any part of the Services or related systems; use automated tools to scrape, mine, or extract content; submit false or misleading information; upload viruses or malicious code; collect personal information of other users; or engage in any activity that could damage, impair, or interfere with the Services. We reserve the right to restrict access to any user who violates these Terms.

SECTION 8 — THIRD-PARTY LINKS AND TOOLS

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Morning Attire LLC is solely responsible for your purchases from this store. Shopify provides the e-commerce platform that enables us to offer the Services, but Shopify is not the seller of record and is not responsible for any aspect of your transactions with us.

If we cancel your order due to a pricing or listing error, you will receive a full refund.

OUR WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

NOTHING IN THIS SECTION EXCLUDES OR LIMITS ANY WARRANTY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

SECTION 14 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MORNING ATTIRE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES OR ANY PRODUCT SHALL NOT EXCEED THE TOTAL AMOUNT YOU ACTUALLY PAID TO MORNING ATTIRE LLC FOR THE SPECIFIC PRODUCT(S) GIVING RISE TO THE CLAIM.

NOTHING IN THIS SECTION EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 15 — INDEMNIFICATION

You agree to indemnify and hold harmless Morning Attire LLC, its owners, members, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms, your violation of any applicable law or the rights of any third party, or your misuse of the Services. This obligation survives termination of these Terms.

SECTION 16 — FORCE MAJEURE

Morning Attire LLC shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, pandemics, fire, flood, or severe weather; war, terrorism, civil unrest, or government action; labor disputes or work stoppages; disruptions to utilities, telecommunications, or internet service; supply chain disruptions or manufacturing delays at our production partner facilities; or shipping carrier delays, customs holds, or postal service interruptions.

In such events, our obligations will be suspended for the duration of the force majeure event, and we will use reasonable efforts to resume performance as soon as practicable.

SECTION 17 — GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, United States, without regard to its conflict of law provisions.

Informal Resolution First. Before initiating any formal proceeding, you agree to contact us at support@morningattire.com to attempt to resolve the dispute informally. We will work with you in good faith to resolve the matter. If a dispute is not resolved within thirty (30) days, either party may proceed as set forth below.

Jurisdiction. Any dispute that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Dane County, Wisconsin. You agree to submit to the personal jurisdiction of these courts.

Small Claims. Either party may bring an individual action in small claims court in Dane County, Wisconsin, for claims within the court's jurisdictional limits.

Individual Claims Only. To the extent permitted by applicable law, you and Morning Attire LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding.

Consumer Rights. Nothing in this section excludes or limits any non-waivable rights or remedies you may have under applicable consumer protection law, including any right to bring a claim in a forum required by applicable law.

SECTION 18 — TERMINATION

We may suspend or restrict access to the Services if we reasonably believe you have violated these Terms or misused the Services. You may close your account at any time by contacting us at support@morningattire.com.

Upon termination, your right to use the Services will immediately cease. You will remain liable for all amounts due up to and including the date of termination, including any outstanding orders already in production.

The following sections survive termination: Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Dispute Resolution.

SECTION 19 — SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

SECTION 20 — WAIVER AND ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Morning Attire LLC regarding your use of the Services, superseding any prior agreements or communications.

SECTION 21 — ASSIGNMENT

You may not transfer or assign these Terms without our prior written consent. Morning Attire LLC may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of its assets.

SECTION 22 — CHANGES TO TERMS OF SERVICE

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
